Schapelle Corby - What to do now The Verdict Is In?

After an exceptionally emotional few weeks leading up to Schapelle Corby’s trial and the reaction to the verdict, it is important to step back and review the scenario with emotional intelligence. What can we do now to assist Schapelle Corby? What do we not know about the Indonesian system? Should we boycott Indonesia? What will be the impact on the War on Terror if we boycott Indonesia? What are we making assumptions about that makes this all seem so ludicrous? Well, the situation is ludicrous, but not for the reasons that most may think… or react to.

Surprisingly the Indonesian justice system is based on the French system which is also the foundation of America’s Constitution. It was interwoven with the Dutch system from their old colonial days in Indonesia. The system was set up with the Executive Branch of the government having no control over the Judicial Branch. This was structured to ensure the government did not have too much control of the people . Consider the Constitution evolved originally from the seeds of the French Revolution with Marie Antoinette's infamous “let them eat cake” statement as her and ole King Louie were, rightfully, thrown by the peasants from power.

So for those outraged that the Indonesian President did not do more prior to the verdict to help Schapelle, consider this; as a result of Marie Antoinette's obscene decadence at the cost of those around her, the French Revolution lead to a Constitution which is the basis of the Constitution in both America and Indonesia to prevent that type of abuse from government. These measures prevented the Indonesian President from being able to intervene .

Just last month those decisions on forming the Constitution also lead to the President of the United States to not being able to intervene in a case to save Terry Shiavo, a beautiful American girl living here in America, although he vigilantly wanted to. He changed his schedule to sign a bill at the eleventh hour after Congress wrote and voted on the bill throughout the weekend to save her. The judges, against Congress and the Presidents wishes, declared this girl who was on life support, should starve to death against her parents’ wishes. The President of the United States could do nothing to overturn the judges’ decision… so Terry Shiavo, very sadly starved to death over 13 long and turbulent days.

The separation of power of the Executive and Judicial Branches is, for the most, part a very good precaution until these very unfortunate cases crop up. So, we cannot blame the Indonesian President for Schapelle’s predicament.

In fact, the Indonesian President is our friend. The majority of Indonesian people are our friends as well . Unfortunately they are being tainted by the small minority of extremists that moved to their island. The locals fear these people but have to live among them and protect their family. It appears political activist judges, and terrorists, are operating in Indonesia as well as America. America has had issues over activist judges working outside the law . This is one of the downfalls of the system, but no system will ever be perfect.

Perhaps the next step is educating the Indonesian people about the affect activist judges and extremists will have on their economy. They voted in a pro-West President in October 2004 so I hazard a guess they already know this. We should look at that election to truly see where the greater heart of the country is. How did they vote? Pro-West. People are jumping to conclusions about Indonesia over media headlines. Remember headline news is mainly dedicated to making money, they need sensatonal headlines to attract readers. Indonesians voted pro-West and that is the meat and potatoes we have to go by, not by what makes headline news. .

So should we boycott Indonesia? Oh, my automatic response is “you bet!” But then I consider the consequences of that action. Everything has a cause and affect. Bin Laden and al Qaida will be very happy with this state of affairs. Set a moderate Muslim country against the West and they can kill each other without al Qaida getting their hands dirty. Don't forget their number one enemy is the West and enemy number two is Muslim countries that are not "Islamic enough," just like Indonesia.

The sad fact is we had just won back the trust of Indonesians after the Iraq war with our selfless tsunami relief effort. Now we will be divided again over this issue. This time it is Australians that have lost faith in their neighbors. It is such a kick in the guts to give Indonesia our money and then to have them treat our citizens this way. But remember it is not the women and children working in the rice paddocks that did this, but the judges. In fact, in a recent poll the Western nations got more favorable ratings than they have in the last five years. So should we boycott? If you don’t feel safe enough or resent traveling their anymore then that is a personal decision we all have to make. I would certainly not recommend government economic sanctions as a response though. I am still trying to find some examples of economic sanctions that have worked successfully… Cuba, Iran, North Korea, Iraq and Libya are the first examples that come to mind. I would hardly call any of them successful.

Just sending a special team in to “nab” Schapelle and bring her home is not an option either. That would be a declaration of war on a friendly nation.

So what recourse is there? Presidential pardon? High court appeal? Constitutional appeal? UN Human Rights Bill? These are the options out on the table at the moment. The Australian government has given Schapelle two Indonesian legal experts to work on her case and should be recognized for their efforts. She also has a new media consultant to handle the barrage of media. Let’s sit back, take a deep breath and see what they come up with.

I know one thing for sure though, there's an Indonesian word: corsar, which means unrefined. In that part of the world it doesn't help your cause if you're seen to be corsar. On the decision to convict Frenchman Michael Blanc recently in Indonesia this was part of the consideration:

"The prosecutor said, ‘Michael is a very nice guy, he’s very young, he’s been very polite in the court and has no criminal record – I ask for the death sentence’,” she said." Sydney Morning Herald

Schapelle is appealing her verdict and needs our support. If it means being patient then that is what we should give her.


"In the movie "Blackhawk Down," helicopter pilot Michael Durant is captured by the Somalis, and U.S. helicopters flew over the city broadcasting over loudspeakers, "Michael Durant, we have not abandoned you...Michael Durant, this is the United States, we will bring you home... " Anonamous. And they evntually did just that.

While the details are being worked out Schapelle is getting that message of hope from all of us too. "Schapelle Corby, we have not abandoned you... Schapelle Corby, this is Australia, we will bring you home." And I believe we will eventually do just that.
